The general terms and conditions of procurement governing the distance selling relationship between INSTITUTE BCN ESTHETICS SL and the user or customer, in accordance with the legal provisions, in particular, Law 7/1998 of 13 April, on General Terms and Conditions of Procurement, Law 3/2014, of 27 March, approving the revised text of the General Law for the Defence of consumers and Users, Law 15/1999 of 13 December, concerning Protection of Personal data, Law 7/1996 of 15 January concerning Retail Trade, and Law 34/2002 of 11 July, concerning Services Information Society and Electronic Commerce.
INSTITUTE BCN ESTHETICS SL reserves the right to make the amendments it deems appropriate, without prior notice, to the General Conditions. These amendments may be made, through its website, in any manner permitted by law, and must be complied with during the time they are published on the web, and until they are validly modified by subsequent amendments. However, INSTITUTE BCN ESTHETICS SL reserves the right to apply, in certain cases, Specific Terms and Conditions of Procurement, with preference over these General Terms and Conditions, as it deems appropriate, announcing the same in appropriate time and manner.
The purpose of the website is to offer and advertise aesthetic products. The products on this website are transdermal therapy cosmetics, and are limited to topical use or through derma rollers, sonophoresis, electroporation, cryoelectrophoresis, and vacuum therapy. That is why only professionals from aesthetic and aesthetic medicine centres can buy them. Buyers assume all risk and agree not to misuse any of the products and must follow the package instructions.
The contractual period will be linked to product delivery without prejudice to the right of cancellation.
A user or a customer expressly declares to know, understand, and accept the terms and conditions of use, and these general terms and conditions of procurement. Similarly, he/she declares to be of legal age and have the legal capacity required for accessing the web sites of INSTITUTE BCN ESTHETICS SL and contracting through the same.

It is an essential requirement to register as a user of the website to make an online purchase. You can access the corresponding section for registration on the website. In accordance with the provisions of Law 15/1999 on Protection of Personal Data, INSTITUTE BCN ESTHETICS SL informs users that the personal data collected during the registration process and subsequent purchase, will be entered into a file under its own responsibility, for the purpose of processing such actions by the user and manage subsequent actions arising therefrom. Essential characteristics of the products
The products offered in our online store include a photograph and essential characteristics thereof, which is the information obtained from the manufacturer. The colour of the product, observable in the photograph is not binding. It is also identified in the characteristics of each product.
Guarantees
All products offered on the website are covered by the supplier’s guarantee. INSTITUTE BCN ESTHETICS SL has an after-sales service, and while the guarantee is in force, the customer may access this by contacting INSTITUTE BCN ESTHETICS SL, after-sales service, by email to info@institutebcn.com or at the points established by the pertinent supplier. Prices
The minimum amount for an order must be €90.
The prices listed on the website are in EUROS not including Spanish VAT (21%). The VAT will be added to the amount of purchased products. For companies within the European Union registered for European VAT, this VAT will not be applied. Customers from outside the EU can buy without Spanish VAT. They do not include shipping costs or export costs (for countries outside the EC) which will be added to the price of the products purchased at the time of order processing.
If any other tax is applicable, this will be indicated.
Customs: Before placing the order, please make sure you will not have problems with the custom authorities at the destination of the products, as we cannot be held liable for any incident and it is responsibility of the customer to know the Customs Regulations in his country.
If your order is returned to origin, we will refund the total of the order minus the cost of shipping back + customs fees. if your order is destroyed by customs, we cannot be responsible for it.
Delivery and transport costs
INSTITUTE BCN ESTHETICS SL delivers free of charge to mainland Spain and the Balearic Islands. Shipments of orders over €250 are free for countries within the European Union.
Taxes and additional expenses derived from export services in the case of countries outside the European Union are included in the shipping amount.
Institute BCN online store works with MRW for shipments to mainland Spain and the Balearic Islands, and with FedEx for the remaining shipments.
Our customers will receive an e-mail from MRW or FedEx confirming the dispatch of their order with the tracking number. They will also be informed of any incident.
INSTITUTE BCN ESTHETICS SL offers its customers the option to pick up their orders using their own transport agency. This must be indicated when placing the order.
When an item is ordered for international delivery, it may be subject to import duties and taxes, which will be charged at the time the package arrives at its destination. The additional expenses due to the customs clearance will be at your expense.

Deliveries
The standard delivery time after receipt and payment of the order can vary between 2 and 10 days, depending on the service chosen and the country of destination.
Payment and execution of the order methods
The customer can pay the amount of his/her order in any of the following ways. During the purchase process the customer must choose the payment method:
– VISA or MASTERCARD credit card
All operations involving the transmission of personal or bank details are made using a secure environment, based on the SSL (Secure Sockets Layer) standard security technology server. Any information you supply to us is transmitted encrypted through the network.

When the purchase amount had been charged fraudulently or improperly using a credit card number, the card holder may demand immediate cancellation of the charge. In such a case, the corresponding debit and recredit entries in the accounts of the provider and the holder will be made as soon as possible.
However, if the purchase had actually been made by the cardholder and the demand for repayment was not as a result of the right of cancellation or termination and, therefore, the cancellation of the corresponding charge had been wrongly demanded, he/she will be obliged to compensate INSTITUTE BCN ESTHETICS SL for damages caused as a result of such cancellation
– Bank Transfer
By selecting bank transfer, you will receive, along with the confirmation of your order, an e-mail with the bank details of INSTITUTE BCN ESTHETICS SL.
When making the transfer, it is very important to indicate in the subject the order number, as well as your name and surname, and make the transfer within 3 days after the date of confirmation of the order to validate this.
If you wish, you can send us the proof of the transfer by e-mail to info@institutebcn.com. However in any event, the order will not be considered effective until our administration department has confirmation of the transfer from the bank.
Please remember that the payment must be made in EUROS and that all possible exchange and banking commissions will be charged to you.
In the case of bank transfers made from outside of Spain, it is very important that, when ordering the transfer, always request your bank to charge the bank commissions and expenses corresponding to your entity at source. Otherwise, INSTITUTE BCN ESTHETICS SL may withhold the shipment of your order on account of not receiving the full amount thereof.
Any possible exchange and bank fees are for the account of the customer.

INSTITUTE BCN ESTHETICS SL is committed to deliver the order in a maximum of 10 days, from the day following the order.
The availability of the products offered by INSTITUTE BCN ESTHETICS SL may vary depending on the customer demand. Although INSTITUTE BCN ESTHETICS SL updates the stock periodically, the product requested by the customer could be sold out at that moment. In case of failure to deliver due to unavailability, INSTITUTE BCN ESTHETICS SL will notify the customer via email as soon as it becomes aware of this situation. The period of this communication will not in any case exceed 30 days. INSTITUTE BCN ESTHETICS SL may provide two options: offer the customer a product of similar or superior quality with no increase in price or, unless there are reasons justifiable and provable by INSTITUTE BCN ESTHETICS SL within the same period, refund the sums paid for the cancelled order. In the event that INSTITUTE BCN ESTHETICS SL does not make this payment within the prescribed period, the buyer may claim to be paid double the amount due, without prejudice to their right to be compensated.
Right of cancellation, returns, and claims
The buyer will have a maximum period of fifteen calendar days from the day he/she receives the product to cancel, without penalty, and without giving any reason.

As set out in Article 103 of the Law 3/2014 of 27 March approving the revised text of the General Law for the Protection of Consumers and Users changes, supplies of services or goods made according to consumer’s specifications or clearly personalised, or which, by their nature, cannot be returned or are liable to deteriorate or expire rapidly, are exempt from cancellation.
– Withdrawal
In accordance with the provisions of Organic Law 15/1999, we inform you that the data obtained from this form will be incorporated into an automated file under the responsibility of INSTITUTE BCN ESTHETICS SL in order to meet your right of withdrawal under the provisions in Law 3/2014, of March 27, which modifies the revised text of the General Law for the Defense of Consumers and Users and other complementary laws, approved by Royal Legislative Decree 1/2007, of 16 November.

The sending of this form implies the formalization of your right of withdrawal and, consequently, the termination of the obligation to execute the contract concluded between the parties. Once your application has been processed, INSTITUTE BCN ESTHETICS SL will send you an acknowledgment of receipt through the communication channel you have indicated in the aforementioned form. We remind you that you must keep it as proof of the exercise of your right of withdrawal.
– Returns
The customer must return or deliver the product directly to INSTITUTE BCN ESTHETICS SL, at the address VIA AUGUSTA 2 BIS EDIF WINDSOR 08006, BARCELONA, without any undue delay, and in any case within a maximum period of fourteen calendar days from the date on which the right of cancellation of the contract has been formalised. The deadline is understood to be met if the customer makes the return of the product before the deadline expires.
INSTITUTE BCN ESTHETICS SL will not be liable for the costs of the return. The customer will pay the costs of returning the product.
In any case, returned products must be in perfect condition, unused, and in its original packaging. We therefore kindly ask you to ensure that the package is properly protected and sealed in order to avoid problems during transportation. Once the returned goods have been received, we will check their status. Once we have checked that the article(s), as well as any components, accessories, promotional gifts and documentation, are complete and in perfect condition, we will refund the money.
– Reimbursement of payment
Reimbursement of the amounts received from the customer will be made using the same payment method used by the customer, provided that an alternative method has not been requested. INSTITUTE BCN ESTHETICS SL may withhold the reimbursement until it has received the product, reason for cancellation, or until the customer delivers return receipt thereof, depending on whichever occurs first.
In case of unreasonable delay by INSTITUTE BCN ESTHETICS SL, regarding the refund of the amounts paid, the customer may claim double the sums paid, without prejudice to the right to be compensated for damages suffered in excess of that amount.
– Return of a defective product
In the event that the product is not in good condition and the customer is not responsible for the causes attributable to this, the customer will be entitled to return the product, informing INSTITUTE BCN ESTHETICS SL of the reason for return through any of the means provided in these contract terms and conditions, and at no cost to the customer. This refund, as a result of defect or poor condition of the product, will not be considered a right of cancellation.
INSTITUTE BCN ESTHETICS SL agrees to bear the cost of return and replace the product with a new one according to conditions agreed at the time of sale.

Jurisdiction

The relationship between the user and the provider will be governed by legislation current and in force in Spain. In the event of any disputes, the parties may submit these to arbitration, or seek recourse under the ordinary jurisdiction, complying with legislation on jurisdiction and competence in this regard.
